Conditions of use

Terms of use

The Epistemic Sonar™ instruments are made publicly accessible so that the protocol can be examined and used. Accessibility is not a transfer of rights, and these terms say exactly where the line falls.

Version 1.0 · in force from 13 August 2026

1 · Scope

What these terms govern

They apply to everything served from mksthronaxis.org, and in particular to the two adjudication instruments.

The instruments are ART-1, which adjudicates a single claim, and ART-2, which adjudicates two rival claims comparatively. Both are case forms of one instrument at version 5.0; the numeral names the case form, not a version.

Using either instrument, or the site, means accepting these terms. If you do not accept them, do not use the instruments.

"The proprietor" below means JPierre Kibiisyo Maiywa-Masai, the author and owner of the works described. "The protocol" means the governed procedure the instruments implement — its stages, its gate architecture, its probe sequence, its audits, and the form of the reports it issues — whether expressed in the program, in the specification, or in any other form.

2 · Grant

What you may do

The permission given is real and deliberately generous about output. It is narrow about the instrument.

Permitted Operate the instruments for your own scholarly, professional, teaching or personal adjudication, without charge and without seeking permission. Including for work you are paid to do. There is no distinction here between academic and commercial operation.
Permitted Keep, publish and rely on the ART report you produce. The adjudication you conduct is your own work product. Publish it, submit it, quote it, build on it. The proprietor claims no ownership of your findings and no right in what you conclude.
Permitted Cite, quote and critique the instruments and the protocol in scholarship, review or teaching, including reproducing short extracts as any fair dealing would allow. Criticism is expressly welcome. A framework that cannot be examined is not a framework.
Permitted Link to the instruments from anywhere, and direct students, colleagues or readers to them.

Attribution, when you publish an adjudication produced through an instrument, is asked as a courtesy of scholarship rather than imposed as a condition: name the instrument and its version. A suggested form is given at §7.

3 · Reservation

What is not licensed

No licence to do any of the following is granted, expressly or by implication, and public accessibility does not create one.

Reserved Copying, adapting or redistributing the program, in whole or in substantial part, whether as source, as a modified version, or by hosting a copy elsewhere.
Reserved Reimplementing the protocol in another program, another language, or another medium. Reading the source is unavoidable in a browser tool and is not objected to. Building the protocol again from what you read is a different act, and it is the act reserved.
Reserved Offering the protocol as a service, whether free or paid, or incorporating it into a product, platform or consultancy offering.
Reserved Use of the marks. MKS™, Thronaxis™, Epistemic Sonar™, Empirical Metadisciplinary Theology™ and Hierarchical Epistemology™ may be used to refer to these works. They may not be used to name, brand or endorse anything else.
Permitted Crawling and indexing. Search engines and AI systems may crawl, index, summarise and cite every page of this site, as robots.txt also states. Being found and cited is welcome. Crawling does not license the reserved acts above: rebuilding the protocol or offering it as a service remains reserved, however the text was obtained.

Permission for any of the above may well be given. It is withheld by default rather than refused in principle — ask, at the address below. Institutional licensing and teaching arrangements are contemplated.

4 · Condition of use

The human gate is a term, not a feature

The instruments exist to govern AI assistance, not to deliver it. Using them as though they adjudicated on your behalf is a misuse of them.

Under the framework's constitutional principle, Sanctified Judgement — Axis IV — is a human act. The instrument decomposes, organises, scans and audits. It proposes. It does not decide, and it is built so that it cannot: the verdict operation is refused at the server, by design, and no assistance is available at the adjudication level.

Accordingly, as a condition of use: do not represent an ART report as a machine adjudication, an AI verdict, or an automated finding. Every gate in a completed report carries the name of the person who attested it. That person is the adjudicator. The instrument is not.

This matters beyond the proprietor's interests. A governed protocol misrepresented as automated judgement does the precise harm the governance exists to prevent.

ART-1 uses no AI at all. It runs the entire protocol in your browser with no network request of any kind. Where AI assistance appears in ART-2, it is confined to decomposition, neutral-language scanning and symmetry completeness-checking, inside gates that permit it.

5 · Your material

What happens to what you type

Stated plainly, because the two instruments differ and the difference matters.

ART-1 Nothing leaves your device. The case is held in your browser's local storage and the protocol completes offline. No request is made to any server. Clearing your browser data deletes the case. Export the JSON to keep it.
ART-2 Only if you press an assist button. The case is likewise held locally and the protocol completes without any network request — but each assist action you invoke transmits the case content (the disputed question, both claims and the symmetry table) to the site's endpoint, which relays it to the Anthropic API to produce that assistance. The proprietor does not store submitted case content beyond what is needed to return the response. Anthropic's handling is governed by its own terms. If your material is confidential, privileged or personal to a third party, use ART-1, or complete ART-2 without invoking assistance.

6 · Status of rights

Rights and their present standing

The instruments, the protocol, the specification, the gate architecture and the report forms are the original work of the proprietor and are protected by copyright in Kenya and, under the Berne Convention, internationally. © 2026 JPierre Kibiisyo Maiywa-Masai. All rights reserved.

The marks are used with ™ and are the subject of pending applications before the Kenya Industrial Property Institute. ™ denotes a claimed mark; it does not assert registration, and none is asserted until granted.

The instruments are not published within the meaning of the Copyright Act. They are publicly accessible for use, which is communication to the public rather than the issue of copies, and that fact is disclosed here for completeness. No publisher is involved and no ISBN, ISSN or equivalent identifier has been assigned.

Nothing on this page waives any right, and no failure to enforce a term operates as a waiver of it. If any term is held unenforceable, the remainder stands.

7 · Limits

No warranty, and what that means here

The instruments are provided as they are, without warranty of any kind. They may be withdrawn, changed or moved without notice. Availability is not guaranteed, and the AI assistance in ART-2 may be unavailable at any time — by design, the protocol completes without it.

More substantively: an instrument that structures reasoning does not validate it. A completed ART report records that a procedure was followed and that a person attested each stage. It does not certify that the conclusion is true. The proprietor accepts no liability for decisions taken on the strength of an adjudication, which remain the responsibility of the person who attested them.

These terms are governed by the laws of Kenya.

Questions, permissions, licensing. Write to [email protected]. Requests to reimplement, teach from, or build on the protocol are read seriously and are not refused as a matter of course.
